Many of you will remember when Spiderman of Denton came to Uvalde in July 2022, bringing over $13,000 in toys to give our children. This was our amazing Spiderman from Denton who came here with a huge team and turned the library into an incredible venue that Sunday with over 3,000 attending.

He brought the inflatables, face painters, balloon twisters, Mickey and Minnie Mouse, Wonder Woman, Superman and the Ghost Busters team along with people who gave away snow cones, ice cream and hot dogs – and, most importantly: HOPE.
It was the VERY BEST day we ever had at the library. And he came back two other times to be in our Christmas parade and for a special event at the Fairplex.
Now he is very ill and I’m asking you to join with me in doing what we can to help with our prayers for his recovery and financial assistance on this site:

Texas District State Senator Roland Gutierrez and former 38th Judicial Assistant District Attorney/ Prosecutor Sara Ruth Spector both leveled criticism against 38th Judicial District Attorney Christina Mitchell after a Corpus Christi jury handed down a not-guilty verdict on Monday, January 21st against former Uvalde CISD officer Adrian Gonzales on charges of child endangerment.

Thursday, January 24th, Gutierrez took to Facebook andz unleashed a profanity-laced rant. He said, “Who really failed was the District Attorney who should have indited the heads of the Department of Public Safety including Stephen Crawford their decision and lack of basic decisions here and who basically left those children to die; mistake after mistake.”

Likewise, Spector took to TikTok  on Thursday, January 22nd and said, “The judge recused herself. The county was moved to where the trial was. The trail was not in Uvalde. The D.A. should have recused herself.  She knew most of the police officers involved. She knew most of the sheriff’s officers involved. In fact, her husband, her ex-husband, was one of the heads of the Uvalde P.D. a decade ago. She had personal relationships with all these people. She should have recused herself completely and let a D.A. with no involvement with this case prior to make decisions, make charging decisions and try the case.”

December 21, 2025

The 38th Judicial District Attorney, Christina Mitchell, has failed to file an appeal within the 30-day period following the Texas Attorney General’s letter decision issued on October 22nd. According to legal counsel consulted by the Uvalde Hesperian, this missed deadline means the original Attorney General’s decision is now final and binding.

On August 22nd, the Uvalde Hesperian submitted a public records request to D.A. Christina Mitchell for the search warrant issued on or about May 24, 2022, for the residence of the Robb Elementary shooter’s grandmother, where the shooter had been living..

On December 3rd, the Hesperian followed up via email. D.A. Mitchell responded the same day, stating, “Additional information was submitted to the AG office.”

However, according to the attorney consulted by the Hesperian, any further communication with the Texas Attorney General does not extend or override the statutory appeal deadline.

The Uvalde Hesperian is now considering legal action, including filing a writ of mandamus in the 38th District Court against District Attorney Mitchell in her official capacity.

In the opinion of the Uvalde Hesperian, District Attorney Mitchell no longer has any legal basis to withhold the requested search warrant

On Saturday. On October 25th, the Uvalde Hesperian received a copy of a letter sent to 38th Judicial District Attorney Christina Mitchell by the office of the Attorney General of Texas Ken Paxton. In the letter it announced its decision on a public records request for the search warrant issued on the residence of Celia “Sally” Gonzalez, where the Robb School shooter was residing prior to the May 24th, 2022, tragedy.

In the letter ruling by the Texas Attorney General is states:

“Pursuant to section 552.302 of the Government Code, a governmental body’s failure to comply with the procedural requirements of section 552.3-1 results in the legal presumption that the requested information is public and must be released unless there is a compelling reason to withhold the information from disclosure.

The letter continues following some case citations listed:

“Although the District Attorney’s office raises the exemption from disclosure, because you have not submitted the information for our review, we have no basis for finding any of the information excepted from disclosure. We have no choice but to order the requested information be released pursuant to section 552.302.”

Upon receiving the letter, the Michael Robinson dba Uvalde Hesperian sent an email on Thursday, October 30th to 38th District Attorney Mitchell asking about the status of the public records request.

That same day, Mitchell replied to the email and wrote: “I will be appealing that decision.”

On August 14th, 2024, Robinson, submitted a public records request for the aforementioned search warrant to the 38th Judicial District Attorney Christina Mitchell.

On August 18th, 2025, Robinson received a response via email from the District Attorney Mitchell stating, “This is to inform you that I have requested an opinion from the Attorney General’s office regarding your request below”

With the email, Mitchell attached a .pdf copy of a letter she electronically sent to Attorney General of Texas Ken Paxon dated August 18th, 2025.

In the letter, Mitchell wrote, ‘Please be advised that the mass shooting that occurred at Robb Elementary School in Uvalde, Texas, on May 24, 2022, remains an ongoing investigation and prosecution of the Texas Rangers, the FBI, and the 38th Judicial District Attorney. Any release of records or reports to that incident would interfere with said ongoing investigation and prosecution and would impede and hinder my ability to prosecute the criminal offenses alleged by an Uvalde County grand jury. I am therefore requesting that the investigation of this incident, specifically, the information requested in said electronic mail be withheld under Section 552.108 of the Texas Government Code. Any release of that information, specifically, the search warrant of the shooter’s home would interfere with the detection, investigation or prosecution of a crime. Any release of evidence as it relates to the information requested is a release of evidence of a crime.”

According to the Attorney General of Texas website addressing what to expect after a ruling is issued:

“Responsibilities for the Governmental Body

When a governmental body receives its letter ruling from the ORD, the governmental body must:

  1. Promptly release the requested information to you if the ruling states to release the information, or
  2. Notify you when and where the requested public information will be provided to you, or
  3. Notify you when and where the requested public information will be made available for your inspection, or
  4. Notify you of the governmental body’s intent to challenge the letter ruling in a District Court in Travis County, Texas. A governmental body has 30 calendar days to challenge a ruling in district court. But less than 1% of letter rulings are challenged in court.”

10-22-25 Following the Uvalde CISD Board of Trustee’s return from executive session at Monday night’s meeting, Attorney Dave Campbell of Thompson and Horton representing the district referenced a lawsuit filed by a group of media entities against Texas seeking the release of records it is seeking pertaining to Robb Elementary School during the May 24th tragedy.

Campbell stated the district is planning on filing an Amicus Brief to the presiding court.

According to Campbell, Texas DPS has 2 terabytes of data it has not released to the media or to the public.

In the Amicus brief. the district recommends to the court that DPS release the records, of which include a hallway video. Additionally, the district urges the video taken by DPS to be released. In a separate letter the district asks the video to be released to Uvalde CISD and once obtained, the district can decide if the video should be released to the public.

Uvalde CISD’s Attorney Campbell also spoke on the district’s plan to file a motion with the Western District Court to clarify the language of the 1982 consent decree.

“The board wants to honor the consent decree; however, Texas Law has changed,”

According to Campbell, the Mireles lawsuit against the district was not about election term lengths but about board of trustees representing the community. At that time, all board of Trustee positions were elected as at-large positions, and it was argued the board members did not adequately reflect the citizens.

Since the decree, the board now elects 3 at-large board members and four board members to represent specific areas within the district.

Dave Campbell stated the firm will file a motion within 2 weeks asking the Western District Court asking it to clean up the language in the consent decree clarifying the language. specifically. We want the judge to recognize the district holds elections in May not April and also the terms are now 4-year terms not 3-years terms.

38th Judicial District Attorney Christina Mitchell has appealed the release of the search warrant issued on or about May 24th, 2022, for the residence of Celia “Sally: Gonzalez; residence where Salvador Ramos was residing prior to the shooting at Robb Elementary School on that same date.

On August 14th, 2025, The Uvalde Hesperian submitted a public records request via email for the search warrant to the 38th District Attorney’s Christina Mitchell.

Mitchell responded via email to the request on August 18th. “This is to inform you that I have requested an opinion from the Attorney General’s office regarding your request below,” Mitchell wrote.

In a letter to State Attorney Ken Paxton, Mitchell appealed the request to release the search warrant citing the search warrant is part of an ongoing investigation.

As part of the District Attorney’s letter, she wrote:

“Any release of records or reports to that incident would interfere with said ongoing investigation and prosecution and would impede and hinder my ability to prosecute the criminal offenses alleged by an Uvalde County grand jury.
I am therefore requesting that the investigation of this incident, specifically, the information
requested in said electronic mail be withheld under Section 552.108 of the Texas Government
Code. Any release of that information, specifically, the search warrant of the shooter’s home
would interfere with the detection, investigation or prosecution of a crime. Any release of
evidence as it relates to the information requested is a release of evidence of a crime.”

On Thursday, September 18th, the Uvalde Hesperian received a return phone call from the State of Texas Attorney General Ken Paxton’s office pertaining to an inquiry on the appeal. A representative from the Attorney General’s Office stated the office has 45 days to make a ruling on the appeal.

School Board Meeting Robb School Teacher Amy Franco and survivor of the May 24th, 2025, tragedy delivered scolding words to the Uvalde CISD trustees during the public comments portion of Monday’s August 25th School Board meeting. Franco said, “You asked us to trust you, but how can we?” referring to public records the district has withheld from release even after, in a previous school board meeting, the Board voted to release the records after an State of Texas appellate court ruled in favor of the plaintiff parties which included the Texas Tribune and other media outlets.

“The Uvalde CISD police officers did not have body cameras on May 24th, 2022 according to Mr. Robb Decker of Walsh Gallegos Law Firm 8,600 emails and 26.000 pages that will be coming according to Uvalde CISD Trustee Jaclyn Gonzales.

Decker stated Texas DPS has possession of hallway footage and the district doesn’t have it.

Trustee Jesse Rizo stated that early in that process regarding public records, Attorney Katie Payne kept district in the dark on specific records being discussed for release

(paraphrased) Rizo slams Uvalde CISD school district legal counsel, Walsh Gallegos Law Firm.

Attorney Robb Decker said it would take time to release many of the emails and other records because private information will need to be redacted as that takes time. He went on to say that more records are set to be released next week on Wednesday.

According to a news report by MSN.com, Decker was quoted as saying, “We, our firm, went back and re-looked at the data that we had received from the district from the beginning and realized that they were correct and that we were wrong,” Robb Decker of Walsh Gallegos said at an emotional school board meeting, which was livestreamed to YouTube.” Expand article logo Continue reading “We had not released all of the responsive information.
