Statement from the City of Uvalde

The City of Uvalde has filed a lawsuit with the 38th District Court against Christina Mitchell Busbee 38th Judicial District Attorney seeking help from a judge to compel Busbee to hand over all relevant law enforcement investigation records and materials from all law enforcement agencies related to the May 24, 2022, Robb Elementary School shooting according to information from official press release.

The press release reads as follows:

“The Uvalde community has waited entirely too long for answers and transparency with regard to
the Robb Elementary shooting incident. Despite the City of Uvalde’s efforts to amicably obtain the necessary investigative materials for
its ongoing Uvalde Police Department’s Internal Affairs investigation, the District Attorney has
blocked the City’s ability to obtain critical information to assess its officers’ actions and
compliance with police department policies and expectations.
Today, the city of Uvalde filed a lawsuit against Uvalde County District Attorney Christina
Mitchell, in her official capacity, asking a judge to compel the District Attorney to hand over all
relevant law enforcement investigation records and materials from all law enforcement agencies
related to the May 24, 2022, Robb Elementary School shooting.
The Internal Affairs review being conducted by an independent investigator, Jesse Prado, is
significantly restricted by the scope of evidence that has not been made available to Prado by
the District Attorney. The request in the suit is requesting that a Judge Order the District Attorney
to turn over the investigative information, solely for Prado’s investigation which will be subject
to a confidentiality and non-disclosure agreement. No one from the City will have access to the
information requested to be turned over to ensure confidentiality of the District Attorney’s
criminal investigation.
From day one, the city’s focus is on helping the entire Uvalde community, parents who lost
children, children who lost parents, and young survivors navigate through the healing process.
Transparency and accountability are part of that process. We hope this lawsuit will allow the
City’s investigation into the conduct of its officers to be completed so as to give the community
and families the answers they deserve.”

38th District Court Judge Dubose orders files sealed on Robb 21 Victims autopsy reports

On Monday afternoon, CNN reported that 28th District Court Judge Camile DuBose ordered the autopsy records for the 19 children and two teachers killed in the May 24th Robb Elementary School massacre to be sealed.

The CNN report states, ” In a motion to seal the records, prosecutors had argued the autopsies could reveal information that authorities need to preserve until the investigation into the shooting is completed.”

“The types, number, and manner in which injuries were inflicted in this case includes information vital to the investigation, apprehension and potential prosecution of individuals that may be

criminally responsible,” the motion reads.'”

According to the CNN report, the motion issued by Judge DuBose effectively seals the autopsy reports for an undetermined amount of time.

The Texas Judicial Commission on Mental Health Website has this information about Judge DuBose: “Elected as Judge of the 38th District Court in 2008, Judge DuBose presides over felony criminal, civil and family law dockets in Uvalde and Real counties.”

  Uvalde Togetherness Day: A free event open to all families in Uvalde and the general public is closed to the press according to a sign at the entrance of the Uvalde County Fairplex and confirmed by a volunteer at the registration table at the event. 

  The Ecumenical Center for Education. Counseling and Health is advertised along with the Uvalde Together Resiliency Center on event fliers and signage as sponsoring organizations for the event.

   The Uvalde Hesperian called the two phone numbers posted on the Uvalde Togetherness Day event sign posted outside of the event as was told the organization would not be doing interviews that day but all families from Uvalde were invited to attend. 

  When asked about the “No Press” sign posted at the main entrance of the Uvalde County Fairplex, a volunteer for the organization explained she thought it was done out of respect for the families. 

  According to a Press Release from the Office of Texas Governor Greg Abbott, the Uvalde Together Resiliency Center was opened as of Monday, June 6th, 2022. 

  “Governor Greg Abbott today announced Uvalde County officials are opening a temporary facility for the newly created Uvalde Together Resiliency Center (UTRC) on Monday, June 6 to begin providing long-term support services for the community. Operated initially by the local district attorney’s office, the Center will offer ongoing mental health resources and other assistance provided by state agencies and local organizations for members of the Uvalde community impacted by last week’s tragic shooting at Robb Elementary School.

  ‘As the Uvalde community works to piece their lives back together, we must come together as Texans to provide the ongoing, comprehensive support needed to move forward from this terrible tragedy,” said Governor Abbott. “I commend County Judge Bill Mitchell, District Attorney Christina Mitchell, Mayor Don McLaughlin, and Superintendent Dr. Hal Harrell for establishing the Uvalde Together Resiliency Center as a single location to meet the needs of the community and provide easily accessible resources and support. Whether it’s counseling or assistance with insurance claims, the Uvalde Together Resiliency Center will be able to serve the community as it heals. Texans are a uniquely resilient people, but that doesn’t mean coping with grief and trauma alone. The State of Texas and local organizations will continue to offer the ‘”support the Uvalde community needs going forward.”’

“The UTRC will be initially overseen by the office of District Attorney Christina Mitchell and will operate through coordinated efforts between local support organizations and state agencies.” according to the press release from the Texas Governor’s Office. 

  The Ecumenical Center for Education. Counseling and Health was approved as a subcontractor for the Uvalde Togetherness Resiliency Center by the Uvalde County Commissioners Court on Monday, July 11ths, 2022.    38th Judicial District Attorney Christina Mitchell Busbee spoke on behalf of the agenda item to the Uvalde Commissioners Court. 

  The First Amendment of the United States Constitution states: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

Senator Gutierrez and Mayor McLaughlin make written plea to Governor Abbott to remove D.A Busbee from Robb Investigation purview

Uvalde mayor Don McLaughlin and I demand that Governor Abbott remove DA Christina Mitchell Busbee as the head of victim assistance after numerous complaints about the Uvalde Together Resiliency Center. Instead we ask that TDEM, a more qualified organization, provide this service.
