Texas State Law covers tenants be provided with hot water and screens for windows, but air conditioning is not covered.

by Michael Robinson | Uvalde Hesperian

It’s May 28th in Southwest Texas and upper 90  degree temperatures have started to set in.  A single mother of two teenages who will be referred to as Jill is  working hard just to make ends meet and finds her rental unit’s air conditioning is not working. So she called the landlord requesting the broken air conditioner be fixed. Days go by and more calls are made but temperatures inside the home reach into the 90’s.

Jill goes out and buys some fans to put in her home to try to mitigate the sweltering temperatures inside her home. The phone calls and emails continue to the landlord and days without air conditioning turn into weeks.  Jill, already dealing with PTSD and other health issues, starts getting sick; sick enough to go to the local emergency room and be admitted due to heat related illnesses. Jill ends up with hospital bills totalling over $18,000 dollars. Her electricity bills skyrocket to $700 from the constant use of fans.

Jill calls City of Uvalde Code Enforcement but is informed there is nothing they can do. Jill’s doctor files a complaint with the Uvalde Resiliency Center.

“I want these people who own this place to bring their family, their children and their pets and I want them to live like my son and my pets and I have lived since May 28th. I mean to tell you I am calling the police. I am so hot I haven’t even slept.  It’s too hot. I’ve had it,” Jill said.

Finally on the Saturday morning of July 30th. 2024 , workers sent by Jill’s landlord bring a replacement Air Conditioning Unit but do not install it. According to Jill, they say they will be back after lunch but fail to show up.  A day or two later the air conditioner is installed.

While some facing this situation would just leave the apartment and likely forfeit their deposit at the current residence, some people like Jill do not have the money to move and pay another deposit at another department or rental.

The Council ultimately approves the measure but not without a discussion on the matter.

According to Uvalde City Attorney Paul J. Tarski of the Tarski Law Firm, if the City creates this new ordinance, it would not be backed up by an existing state law.

“To be clear, there is no federal and there is no state statute with the exemption that Dallas and Houston have passed it, One of them is already being challenged in court,” Tarski said.

He continued, “If someone wants to attack it, in our opinion you’re going to lose.”

King stated that he has been getting calls since I’ve gone on council.  He said he’d usually tell them to call somebody. “There is nobody to call,” King said,

King stated within the last three months, he had received calls from two young ladies who didn’t have hot water and the landlord refused to fix it.

“For the health and safety of people, I think we can take that chance.” King said.

“Why are we getting involved?” Councilman Hector R. Lueveno said.

“Because there is no one to call. Literally no one to call.” King said.

Anheuser-Busch and Silver Eagle Beverages, in partnership with the National Volunteer Fire Council (NVFC), have provided more than 4,500 cans of emergency drinking water to help Nueces Canyon and La Pryor Volunteer Fire Departments as they continue to protect our communities and prepare for any upcoming relief efforts.

With volunteers comprising 67% of firefighters in the United States, they are local communities’ first line of defense in a range of emergencies, while often operating with limited resources and staffing. For these local heroes, clean drinking water is essential to ensure they can be at their peak performance when protecting our communities.

“Once again, we are proud to partner with Anheuser-Busch to provide drinking water to both the Nueces Canyon Fire Department and La Pryor Volunteer Fire Department,” said John L. Nau III, Chairman and CEO of Silver Eagle Beverages. “Emergency drinking water is critical for firefighters’ safety and ability to respond to crises. We thank these brave volunteer firefighters for their commitment to keeping our communities safe.”

The donation of emergency drinking water was sourced from Anheuser-Busch’s brewery in Cartersville,

Georgia, which periodically pauses beer production to can clean and safe drinking water to be delivered to communities in times of need.

Anheuser-Busch has a longstanding tradition of providing emergency drinking water and supplies for disaster relief efforts in partnership with the American Red Cross – dating back to 1906. Since the inception of its emergency drinking water program in 1988, Anheuser-Busch has donated more than 90 million cans of clean drinking water to U.S. communities affected by natural disasters and other crises. Through its partnership with the National Volunteer Fire Council (NVFC), the national association representing America’s volunteer fire departments, Anheuser-Busch also donates emergency drinking water each year to provide critical hydration to volunteer firefighters. Since its launch in 2019, the program has donated over 4.8 million cans of water to volunteer fire departments across the country to help firefighters stay hydrated and healthy when protecting the communities where we live and work.

The “Heartrock Guy” Tom Ballard is coming back to Uvalde this Sunday, September 24th  visiting local churches and September 25th from 10 AM to 6 PM at El Progreso Memorial Library to bring polished hearts of stones made to hold in the palm of one’s hand or keep in one’s pocket. The stones are offered free of charge.

El Progreso Memorial Library Director, Mendell Morgan  wrote, “The Heartrock Guy” is coming back to Uvalde.  Tom Ballard of Utah made quite an impression last year when he came to Uvalde with many heartshaped rocks he gave as a gift of love and support.

These are stones he gathered, shaped and hand polished to represent love which he shared with our community.  He has not forgotten us and plans to return Sunday, September 24th with 2,000 more.

He will attempt to visit as many churches as possible when services begin or end to offer heartshaped rocks with parishoners.

He plans to be at El Progreso Memorial Library for most of the day Monday the 25th between 10 a.m. and 6 p.m. for those who would like to come by to receive one as his gift.”

                                                                         Why Heart Rocks?

Ballard’s website  has the following statement about  Take Heart Rocks

“In early 2019, as an emergency substitute teacher on a reservation in Washington, my heart broke for my students. Many of them lost family members to suicide. Many grieved for months and I didn’t know how to help them.

I began giving them naturally-shaped heart rocks I found on the beach. I would tell them something like, ‘I hope every time you see your heart rock it reminds you that you matter, you are loved, and seen, and you are never alone.’

When I couldn’t on the beach, I began making them.”
